These terms govern your use of AlyOps at mostafaaly.com.

Agreement

These terms govern your use of AlyOps at mostafaaly.com. By using it, you accept them. If you do not accept them, do not use it.

AlyOps is operated by Mostafa Aly, acting in his personal capacity.

What AlyOps is

AlyOps is a reference work and operational toolkit for beverage preparation and service. It contains procedures, technical reference material, calculators, and learning material. It is provided free of charge.

What AlyOps is not:

• It is not a substitute for professional judgement
• It is not a substitute for the requirements of your regulator, your employer, or your local food safety authority
• It is not a certification body, and it is not accredited by one
• It does not create a professional, advisory or employment relationship between us

Your licence to use AlyOps

You may use AlyOps for your own professional and educational purposes, free of charge.

You may not:

• Copy, republish or redistribute the content beyond what the content licence in Section 4 permits
• Use automated means to extract the content in bulk
• Resell, sublicense, or commercially exploit the content
• Remove or obscure any authorship, licence or attribution notice
• Attempt to gain unauthorised access to any part of the service, or to another person's data
• Use the service to break any law, or in a way that damages the service or other users

Intellectual property

Our content

The content of AlyOps — the written procedures, reference material, calculators, learning material, structure, design and code — is the intellectual property of Mostafa Aly and is protected by copyright.

Unless stated otherwise on a specific page, the content is made available under the Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International licence (CC BY-NC-ND 4.0). That licence, and its legal code, govern what you may do with it. These terms neither add to it nor take away from it.

In the licence's own words: you may share the material in any medium or format, with attribution; you may not use it for commercial purposes; and if you remix, transform or build upon it, you may not distribute the modified material. The operative definitions — including what counts as commercial — are in the legal code, not in this paragraph.

Third-party standards and materials

AlyOps refers to industry standards and published works produced by third parties. Those works remain the property of their owners. AlyOps does not reproduce them, and reference to a standard does not imply endorsement by, or affiliation with, the body that publishes it.

Your content

Any records, notes or data you create in AlyOps remain yours. We claim no rights over them. Most of it never leaves your device.

Accounts

AlyOps does not currently offer user accounts. If account features are introduced, these terms will be updated before they are made available.

Availability

We aim to keep AlyOps available, but we do not guarantee it. We may change, suspend or withdraw any part of it at any time, with or without notice.

AlyOps is designed to function offline. If the service becomes unavailable, material already stored on your device generally remains usable.

Disclaimer of warranties

AlyOps is provided free of charge, as is and as available.

To the fullest extent permitted by law, we exclude all warranties, conditions, representations and terms of any kind, whether express or implied, including without limitation any warranty as to accuracy, completeness, currency, merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.

The Disclaimer page forms part of these terms and sets out specific limitations relating to food safety, technical figures, equipment and regulatory compliance.

Limitation of liability

AlyOps is provided free of charge. To the fullest extent permitted by law, we accept no liability whatsoever arising from your use of AlyOps, your inability to use it, or your reliance on any of its content.

Without limiting Clause 8.1, and to the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, nor for any of the following however arising, whether in contract, tort including negligence, or otherwise:

• Business loss, loss of profit, loss of revenue or loss of anticipated savings
• Loss of or corruption of data
• Loss of goodwill or reputation
• Any fine, penalty, closure or enforcement action imposed by a regulator
• Loss of, or damage to, product, stock or equipment
• Any injury, illness, allergic reaction or adverse health outcome arising from the preparation, handling or service of any beverage or food
• Any cost of procuring substitute services or information

Where liability cannot lawfully be excluded, our total aggregate liability to you in respect of all claims arising from or in connection with AlyOps is limited to the total amount you have paid to us, which is nil.

Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be excluded or limited.

You acknowledge that AlyOps is a reference work, that the exclusions and limitations in this clause are reasonable given that it is provided free of charge, and that you accept full responsibility for verifying any material before relying on it in a commercial or regulated setting.

Indemnity

You agree to indemnify us and hold us harmless against any claim, demand, loss, liability, cost or expense, including reasonable legal fees, arising from:

• Your use of AlyOps in breach of these terms
• Your reliance on any content in a commercial, operational or regulated setting
• Your infringement of any third party's rights
• Any claim brought against us by a customer, employer, employee or regulator in connection with your use of material obtained from AlyOps

Links to other sites

AlyOps links to external resources. We do not control them and are not responsible for their content, their accuracy, or their privacy practices.

Termination

We may suspend or terminate your access if you breach these terms.

You may stop using AlyOps at any time. To remove the data held on your device, clear the site data in your browser or uninstall the application.

Severability

If any provision of these terms is held to be invalid or unenforceable, that provision is severed and the remainder continues in full force.

Governing law and jurisdiction

These terms, and any dispute or claim arising from or in connection with them or their subject matter, are governed by the laws of the Kingdom of Saudi Arabia.

The courts of the Kingdom of Saudi Arabia have exclusive jurisdiction over any such dispute or claim.

Changes to these terms

We may update these terms. The version number and effective date at the top always tell you which version applies. Material changes will be published before they take effect.
